The Supreme Court reminds us of this in its draft.
“The explanations prepared by the plenary session of the Supreme Court of Russia are aimed at improving judicial practice,” explained Vladimir Gruzdev, chairman of the board of directors of the Russian Bar Association. “For example, the draft resolution clarifies that a man must be considered the sole parent if, in particular, the child’s mother is declared incapable, deceased, declared deceased, declared missing or deprived of parental rights.”

In this case, the court must determine whether the mother or father truly cares about the child. Or adults simply hide behind crumbs, but actually live alone. Vladimir Gruzdev emphasized that when applying the provisions of the Criminal Code on postponement of punishment, parents cannot include persons who, by court decision, have limited or deprived parental rights, other close relatives of the child and guardians .
“When deciding on postponement, the court must take into account information about the personality of the person, his behavior during the period of serving the sentence, the living conditions of the person and his family, the availability of housing and the conditions necessary to live with a child and other people,” said Vladimir Gruzdev.
Another clarification: a deferral is granted to pregnant women regardless of the stage of pregnancy. The draft resolution was sent for review.
By the way, next year the parole law will come into force. Mechanisms aimed at the social rehabilitation of convicted persons are beginning to operate. They will begin to work with prisoners who are already in prison.
